It’s common to assume that a company’s D&O insurance policy will automatically cover a director or executive. Unfortunately, this isn’t always a safe assumption to make. It’s wise to seek confirmation about the adequacy of a D&O policy before you need to make a claim. Or it may be far too late.

Duty of Disclosure requirements – not an annual activity
Why is continual and accurate disclosure to an insurer vital? Because absent or inaccurate disclosure can impact a policy’s validity and protection. Disclosure of material facts must be considered regularly – not annually. Covid has impacted many organisations – employee work locations and new work practices for example.
